To meet social expectations, the Minister of the Environment decided to introduce the obligation to monitor waste landfills from February 22, 2019 . The introduction of the Act is the result of increasing phenomena in recent years regarding improper management of waste storage, in particular many fires in May 2018.
Who is obliged to have a video control system?
The obligation to monitor the area rests with enterprises that store or deposit flammable waste, such as:
- Alternative fuel and waste intended directly for the production of such fuel;
- Paper and cardboard;
- Textiles;
- Bulky waste, excluding metal waste;
- Plastics, including: foil, tires and other rubber waste;
- Wood and wood-based waste;
- Waste from the processing of municipal waste;
- Multi-material waste composed of materials referred to in points 2, 3, 5 or 6.
How is the system to be installed?
The cameras are to have an operating mode ensuring continuous viewing without disruptions, at any time of the day or night (automatic adjustment to weather conditions) . The technical parameters of the control system devices are to be in accordance with the standard: PN-EN 62676-4:2015-06 . Breaks in image recording are allowed only for the purpose of carrying out system maintenance work , but not longer than 2 days a year and provided that the relevant voivodeship environmental protection inspector is informed at least three days in advance.
The system is to be protected against loss of power by providing emergency power for at least 2 hours (this requirement significantly increases the cost of monitoring). Additionally, monitoring must be able to be viewed via the Internet in real time (in units subordinated to and supervised by the Minister of National Defense, there is no real-time transmission. The image recording from the camera is archived and stored on an electronic information carrier in an organizational unit subordinated to or supervised by the Ministry of National Defense). . Access to monitoring (login and password) should be provided to the appropriate WIOŚ (Provincial Inspectorate of Environmental Protection). The saved image or its copy is made available immediately at the written request of the authorized entity. The image from the cameras is to be able to be reproduced using the so-called freeze frames, it is also intended to allow the identification of people appearing in it. Additionally, it must contain the date and time of recorded events and activities and must remain unchanged.
The capacity of the medium is to enable the storage and playback of the recorded image for at least one month from the date of recording, after which the recorded image is automatically destroyed . The medium should be properly stored and protected - in particular against data loss, harmful effects of chemicals, temperature, light, radiation, fire and mechanical damage, as well as access by unauthorized persons.
The room in which the medium will be stored should constitute a separate fire zone, separated in accordance with the conditions specified in the regulation issued pursuant to Art. 7 section 2 point 1 of the Act of July 7, 1994 - Construction Law (Journal of Laws of 2018, items 1202, 1202, 1276, 1496 and 1669) , which specifies the technical conditions that buildings and their location should meet. Fire separation elements separating the room should have a fire resistance class of at least REI 120 and should be located at a distance of at least 10 m from the place of storage or waste storage.
Area At the entrance to the place of storage or storage of waste covered by the control system, information about the operation of the visual control system is placed . Monitoring is to enable image registration covering the entire area of stored or stored waste, including access roads (internal) located on the premises of the enterprise and an external strip surrounding the place of storage or storage of waste with a minimum width of 5 m, provided that the enterprise has ownership rights to this area. In enterprises with an area of stored or stored waste exceeding 2 hectares, image recording is allowed covering a strip with a minimum width of 15 m, measured horizontally from the outer edge of the stored or stored waste towards the inside. If waste is stored or stored in a closed room, it is allowed to register up to the border of the internal walls of the room (without the strip surrounding this place), including the registration of the image of the entrance and exit gate to this room.
The regulation enters into force after 3 months from the date of announcement, with the exception of room requirements - these enter into force on February 22, 2021.
What after February 22?
After the Act enters into force, Environmental Protection Inspectors will be able to carry out unannounced inspections 24 hours a day. Failure to comply with the act may result in a fine of PLN 5,000. PLN (if a given entity repeatedly violates the Act, an appropriate multiplier of this amount will be applied).
